Civil War: Confederate Scouts were crossing the river where Russell Fork runs into the Levisa River, and someone shot at them from the hillside. They stopped at Peyton's house and found him sick in bed. When he could not tell them whofired the shot, they took him with them a few miles down river to the mouth of Dry Fork. Here they killed him. Later a man was coming down the road and stopped to rest on a log. He found Peyton Justice's body. The Confederate soldierswere under the command of Nathaniel McClure Menifee, which had a ruthless reputation for killing innocent citizens, and was relieved of command in early 1863. Mary Polly Blackburn-Justice had Menifee, and several men, indited, but theynever stood trial.
Cincinnati, OH, Daily Commercial, August 28, 1862: Captain William Ford, of Pike County, informs the Sandy Valley Advocate that the Rebels visited the house of Mr. Lewis Sowerds, in that County and robbed the family of everything theirhouse contained. They also arrested Mr. Peyton Justice, an Old man of 78 Years, and took him to the woods and shot him dead. The ball entered the back part of his head and came out his forehead. His body was left lying where he wasmurdered.

Robert Peyton Justice's marriage to Mary Polly May was dissolved in Floyd County Court on November 4, 1816.
From the book "The Big Sandy Valley" by William Ely, written in 1887, lists the Justice family as being among the first families in the Sandy Valley (Floyd County) in the late 1700's. It also says the Justice family and others wereengaged in the timber trade in the early days. The book states "The Justice's were, in their earliest days on the Sandy, large slave-owners, and had an eye single to the importance of owning, not only negro slaves, but a great deal ofland also. The Justice's of the valley are still large owners of land, and many of them leading citizens of the community. The decendants of William Justice and wife, Miss Bevins before her marriage, are found in every county borderingon the Sandy River. The book states that Flemming Justice made brick in Hamton City.

Marietta, GA 30066Last Came the baby of the family named Peyton Justice. Peyton seems to have first married Polly May and a few years later Polly Sloan. As far as I know, the following children were with Polly Sloan. Children were; Mary Elizabeth Justice,America Justice, Polly Justice, Pricy Justice , Green Justice, William Justice, James Epperson Justice, Hutson Justice and Sarah Justice. Peyton lived at the mouth of Peyton's Creek and met his death there at age 74 in 1864 when he waskilled by marauding Confederate Scouts. After the war ended, his widow obtained an indictment of murder for eleven Confederate troops but no one was ever brought to trial. I will include here the will of William Justice 1742-1813. Thiswill is on file at Prestonsburg and was first discovered by Terry Anderson of Maysville. Terry is three times a Justice and a very dedicated genealogist. I owe him a great deal in unraveling the different Justice relationships in Floyd andPike County.

Simeon and Polly received their first land grant in Floyd Co., KY. on March 6, 1817 on Grapevine Creek. Polly's father, Peter, had given them one male and two female slaves when they married, as he did all his children. Theseslaves helped clear the land. Simeon was well educated and became involved in local politics. Simeon was a minister of the Primitive Baptist Church. He was also County Judge of Pike Co., KY.

Marietta, GA 30066The 2nd child of William and Margaret was my gggg grandfather William Justice. His wife's name was Sarah and even though her name is on several deeds and census documents. I still don't know for sure her maiden name. Other Familyresearchers have said Blevins/Bevins/Blackburn/Berry/Blankenship/Tackett and Thacker. It is ironic that I have found the spouses of all of William and Margaret's children except my own direct line. William and Sarah lived on Mud Creek inFloyd County until 1836, when they too moved away to settle at the mouth of Big Lick Branch on Rock Castle Creek in Lawrence County, KY. As what seems to be a custom of the Justice families, all of William and Sarah's children moved withthem. Their children were, William Justice, James Justice,George Justice,Mary Justice, John Justice, Caleb Justice, Peyton Justice , Sarah Justice and David Justice. All were married at the time of their move except Sarah, Peyton, andDavid. Their marriage records can be found in Lawrence County.
