Jasper McFall Gets Life

Mountain Eagle, Whitesburg, Letcher Co KY, April 28, 1948: McFall Gets Life Without Pardon For Wife's Murder. Jasper McFall, 45, plead guilty to the charge that he murdered his wife and was sentenced Wednesday of this week in Letcher Circuit Court to life imprisonment. The jury recommended that he never be paroled or pardoned. McFall was charged with killing his wife at their home on Dryfork Feb. 15, 1949. He was accused of beating her to death with a broken shotgun. He was arrested in Wise, Va., a few hours after the incident and brought back to Letcher Co.

In the county jail, McFall did not deny slaying his wife, but said he didn't remember clearly what happened. "I guess I just went crazy," he said. "My wife was always good to me." Commonwealth Attorney Augustus (Gus) Cornett recommended to the jury that they return a verdict of guilty and fix punishment at life without parole or pardon. Cornett said that, had McFall fought the case through, it would have been necessary to use his own sons' testimony to secure a conviction.

The jury was out about fifteen minutes the first time and came back and reported that they could not agree because they did not understand the instructions. Judge Sam Ward explained that the court did not want to use the McFall sons' testimony to secure a death sentence because they might in later years regret having been instrumental in sending their father to his death. The judge explained that a verdict of life imprisonment without hope of pardon was not binding by law but would carry great weight with state prison authorities. The jury went out again and returned in about fifteen minutes with a verdict of guilty and fixed punishment at life imprisonment without parole or pardon.

Judge Ward passed sentence on McFall immediately following. He instructed Circuit Court Clerk W L Stallard Jr.. to send a certified copy of the verdict to La Grange with McFall. Mrs. McFall was 44. There were eight children in the family, ranging in age from five to 20. At the time of McFall's arrest Sheriff Herman Combs said that McFall was tried about a year ago on a charge of shooting his wife in the arm, but was freed in that trial.
